리플(XRP) 커뮤니티를 대변하는 미국 변호사 존 디튼(John E Deaton)이 최근 트위터를 통해 “‘리플랩스와 XRP는 공동기업(common enterprise)’이라는 미 증권거래위원회(SEC)의 비정상적 주장 탓에 담당 판사가 향후 약식 판결을 내리지 않을 가능성이 있다”고 전했다.  이어서 “이 경우 판사는 공동기업이 실제로 존재하는지 대해 사실관계를 따져봐야 한다고 판단할 수 있다”고 덧붙였다.  얼마전 디튼은 “SEC는 XRP가 증권으로 간주돼야 한다는 주장을 입증하기 위해 리플랩스와 XRP는 공동기업이라는 논리를 펼치고 있다. 하지만 이러한 논리에는 허점이 존재한다”고 지적한 바 있다.
